01Scope of this policy
This policy applies to personal information we collect through our website, when you communicate with us, when you request or use our services, and through the advertising and marketing technologies we operate. It does not cover the privacy practices of third-party websites, platforms, or our clients, which are governed by their own policies. Section 9 explains how we handle information we process on behalf of our clients.
02Who we are
Smith Sales Solutions LLC (“Company,” “we,” “us,” or “our”) is a marketing and sales-enablement business based in Lowell, Indiana. For most information collected through our own website and marketing, we act as the party responsible for that information (a “controller”). For information we process to run services on behalf of a client, we act on that client’s instructions (a “processor” or “service provider”). Our contact details are in Section 18.
03Information we collect
Information you provide to us
- Contact and identity information — such as your name, business name, email address, phone number, and mailing address when you submit a form, book a call, subscribe, or contact us.
- Communications — the content of messages, emails, chats, and calls you exchange with us, which may include recordings or transcripts of calls and AI-assisted conversations where permitted by law.
- Business and transaction information — details about your business, the services you request, and billing or payment information (payment card details are handled by our payment processor, not stored by us).
Information collected automatically
- Device and usage data — such as your IP address, browser type, device identifiers, pages viewed, referring pages, links clicked, and interactions with our site and ads.
- Cookies and similar technologies — as described in Section 5, including advertising and analytics identifiers.
- Approximate location — derived from your IP address.
Information from third parties
- Advertising and analytics platforms — such as engagement and conversion data from Meta and Google.
- Lead sources and referrals — contact details you submit through ads, landing pages, or partner referrals.
04How we use information
We use personal information to:
- Provide, operate, and improve our website and services;
- Respond to inquiries, schedule calls, and communicate with you about our services;
- Deliver, measure, and optimize advertising and marketing campaigns;
- Process payments and manage our business relationship with you;
- Personalize content and understand how our website and ads perform;
- Maintain security, prevent fraud, and enforce our Terms of Service; and
- Comply with legal obligations and exercise or defend legal claims.
Where required by law, we rely on your consent for certain activities (such as some marketing communications and non-essential cookies) and you may withdraw that consent at any time.
05Cookies & tracking technologies
We and our providers use cookies, pixels, tags, and similar technologies to operate the site, remember your preferences, analyze traffic, and measure and serve advertising. Some are strictly necessary for the site to function; others are used for analytics and advertising.
You can control cookies through your browser settings and, where available, through a cookie or consent banner on our site. You can also opt out of certain interest-based advertising through industry tools such as the Digital Advertising Alliance (optout.aboutads.info) and the Network Advertising Initiative (optout.networkadvertising.org). Disabling some cookies may affect how the website works.
06Advertising & the Meta Pixel
Because advertising is central to what we do, our website and campaigns may use the Meta Pixel and Conversions API, Google tags, and similar technologies to measure ad performance, build audiences, and show you and others relevant ads on Meta (Facebook and Instagram), Google, and other platforms. This may involve collecting your interactions with our site and sharing certain identifiers (such as a hashed email address, device identifiers, or cookie IDs) with these advertising platforms, which use them in accordance with their own privacy policies.
Depending on your state of residence, this advertising activity may be considered “sharing” of personal information for cross-context behavioral advertising or “targeted advertising.” We do not exchange your personal information for money, but if you would like to opt out of this activity, see Section 12 and Section 13.
07Text messaging & automated communications
If you provide your phone number or opt in to receive text messages, you may receive SMS/text communications from us or from systems we operate — including AI-assisted messages — for purposes such as responding to inquiries, scheduling, reminders, and updates.
- Message frequency varies. Message and data rates may apply.
- You can opt out at any time by replying STOP, and reply HELP for help.
- Consent to receive marketing texts is not a condition of purchase.
- We do not sell or share your mobile phone number or SMS opt-in information with third parties or affiliates for their own marketing purposes.
Automated and AI-assisted communications may occasionally be inaccurate; a path to reach a person is available. This section works together with Section 8 (“AI & Automated Communications”) of our Terms of Service.
08How we share information
We do not sell your personal information for money. We share personal information only as described below:
| Who we share with | Why |
|---|---|
| Advertising platforms (e.g., Meta, Google) | To run, measure, and optimize advertising and build audiences |
| CRM & automation providers (e.g., our marketing/CRM platform) | To manage contacts, communications, and appointment setting |
| Telephony & messaging providers | To send and receive calls, texts, and emails |
| Analytics providers | To understand website and campaign performance |
| Payment processors | To process payments securely |
| Professional advisors & authorities | To comply with law, respond to legal requests, or protect our rights |
| A successor entity | In connection with a merger, acquisition, or sale of assets |
These providers are permitted to use personal information only to perform services for us, except where they act as independent controllers under their own policies (such as advertising platforms). We may also share information with your consent or at your direction.
09Data we process for our clients
When we provide services to a business client — for example, generating leads and setting appointments — we process personal information about that client’s leads and customers (“Client Contacts”) on the client’s behalf and under the client’s instructions. In that role, the client is the party responsible for that data, and the client’s own privacy notice and consent practices govern it. If you are a Client Contact and want to access, correct, or delete your information, please contact the business you interacted with; we will support that business in responding to your request.
10Data retention
We keep personal information for as long as needed to fulfill the purposes described in this policy — including to provide services, maintain business records, and comply with legal, tax, and accounting obligations — and then delete or de-identify it. Retention periods vary depending on the type of information and the reason we hold it. When we process data on behalf of a client, we retain it according to our agreement with that client.
11How we protect information
We use commercially reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, or alteration. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your own account credentials confidential.
12Your privacy rights
Depending on where you live, you may have some or all of the following rights regarding your personal information:
- Know / access — request the categories and specific pieces of personal information we hold about you;
- Correct — request correction of inaccurate information;
- Delete — request deletion of your personal information, subject to legal exceptions;
- Opt out of targeted advertising / “sharing” — opt out of the advertising activity described in Section 6;
- Opt out of marketing — unsubscribe from marketing emails via the link in each email, or reply STOP to texts;
- Non-discrimination — we will not discriminate against you for exercising your rights.
To exercise these rights, contact us using the details in Section 18. We will verify your request and respond within the time required by applicable law. You may use an authorized agent to submit a request where permitted, and you may appeal a decision by contacting us again. We do not knowingly sell personal information, and we do not use or disclose sensitive personal information beyond the purposes allowed by law.
13Do Not Sell or Share My Personal Information
We do not sell personal information for money. However, our use of advertising technologies such as the Meta Pixel (Section 6) may be considered “sharing” for cross-context behavioral advertising or “targeted advertising” under certain state privacy laws. To opt out, you may:
- Email us at [email protected] with the subject line “Do Not Sell or Share”;
- Adjust your choices in any cookie or consent banner on our site; and/or
- Use the browser-based Global Privacy Control (GPC) signal, which we honor where required by law.
Opting out of the advertising cookies on your browser applies to that browser and device; you may need to opt out again if you clear cookies or use a different device.
14Children’s privacy
Our website and services are intended for businesses and adults. We do not knowingly collect personal information from children under 18 (or under 13 as defined by applicable law). If you believe a child has provided us personal information, please contact us and we will delete it.
15Third-party links
Our website and communications may link to third-party websites or platforms that we do not control. This policy does not apply to those third parties, and we are not responsible for their content or privacy practices. Review the privacy policies of any third-party sites you visit.
16U.S.-based services
Our website and services are intended for users in the United States, and personal information is processed in the United States. If you access our website from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
17Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of our website or services after changes take effect constitutes acceptance of the updated policy.
